Credit counseling is indeed the most important part of any bankruptcy case. Actually it is necessary that you complete a briefing with such a credit counseling agency which is certified and that has been approved by the U.S. Trustee’s Office.
This requirement has been in place, since October 2005, and because of it, a failure to complete credit counseling within 180 days prior to filing may result in the rejection or dismissal of your Chapter 7 or Chapter 13 bankruptcy case. As you finished your course of credit counseling, you will receive a certificate which indicates your completion that must be filed with your bankruptcy petition.
On average a credit counseling course is approximately of $50, but the exact cost is not fixed and its depend upon what type of session you undergo and where you live. It is also possible to take briefing via phone or online as well. Briefing usually includes an evaluation of your finances, a personal budget plan and the discussion of other option to bankruptcy, if any found. There are usually only few exceptions to the requirement that a debtor can complete a credit counseling course prior to filing for bankruptcy. court judges of Bankruptcy do not have any authority to waive this requirement, so it is very necessary that you discuss this with your skilled and experienced attorney prior to filing. Remember that you’re being unable to file for a certain period of time if bankruptcy case results as dismissed. |
